COURT OF PROTECTION

Old age, illness, deteriorating mental health, an accident or a brain injury could leave any one of us vulnerable, lacking the mental capacity to make decisions about our care and welfare. Alternatively, family disagreements or a dispute with a third party (NHS or Local Authority) about what care our loved ones should receive leave us fraught and anxious. 

Whatever the situation, tough decisions need to be made on their behalf, knowing that perhaps, the outcomes are not what they would have wanted, but their best interests are at heart. This is where we ask the Court of Protection to decide on what's best.

POWER OF ATTORNEY ADVICE

Accidents, illnesses and injury can cause us to lose mental capacity, so we are unable to manage our own affairs. Should this happen, our loved ones cannot just pick up the pieces on our behalf, access our bank accounts to pay bills or have a say on what care we should receive.

This is where we need a Lasting Power of Attorney. It will allow us to appoint someone we know and trust to make the right decisions for us and our future. We all need someone to rely on and having a Lasting Power of Attorney in place is worth its weight in gold.

 

Making a Lasting Power of Attorney protects your interests, ensuring the right people take the best care of you and your affairs.

Once in place, it does not give your Attorney free reign to do as they please. What they can and cannot do is strictly set out by rules in the Mental Capacity Act 2005.

 

No one can ignore a Power of Attorney – it is legally binding. At times when family members struggle to agree on what is best, a Power of Attorney provides you and your loved ones with peace of mind.

PLANNING & PAYING FOR CARE

The care system can be challenging.  With more questions than answers, this stressful time can often lead to conflict between family members when trying to agree on what’s best.

  • Do we have to fund our own care? Can we get Local Authority funding to help pay for care in our own home or help with paying for care home fees?

  • We are being told we need NHS Continuing Healthcare – how do we apply for this? We’ve been asked to fund a third-party top-up to go towards care home fees – should we be paying for this? By having a deferred payment agreement, does this mean we won’t have to sell the house to pay for care?
